Several complaints were made in September 2020 about Justice David Spiro – the donor at the heart of the IHRP scandal – to the Canadian Judicial Council. A panel of the CJC ultimately decided that, although it was a “serious error” for Justice Spiro to intercede in the hiring process for the IHRP Director in the way he did, his behaviour was not serious enough to justify a full inquiry. The complaint was closed. The original complainants have now applied for judicial review of that decision. The document below is the official record of the material before the CJC. It is a public document, available from the Federal Court. It reveals a great deal about what went on behind the scenes in the run-up to the decision to terminate the hiring process, further illustrating the problems with advancement culture at U of T, the gaps in collegial governance, and the secretive investigation conducted by Thomas Cromwell.
